JOB DESCRIPTION

JOB SUMMARY: Under the general direction of the Dry Creek Rancheria Board of Directors the Tribal Counsel is responsible for providing general legal services to for the Tribal Government. The primary client is the Board of Directors, the five-member elected governing body of the Dry Creek Rancheria Band of Pomo Indians. Legal services are also provided to the various Tribal Departments and entities on an as-needed basis such as economic development and tribal business enterprises. Generally, the work of this position will focus on natural resources, cultural resources, contracts, environmental issues, corporate and business matters, Tribal courts, Tribal Codes and real property law.

JOB RESPONSIBILITIES:

1. Research matters affecting the legal rights and interests of the Tribal Government.
2. Advise the Board of Directors and its agents concerning the Tribe’s legal rights and interests and develop strategies to promote and protect those interests.
3. Litigate on behalf of the Tribe before Tribal, federal, and state courts and administrative agencies.
4. Draft legislation (for Tribal, federal, state and local legislative bodies) promoting and defending the legal rights and interests of the Tribal Government, Tribal members and the Reservation community.
5. Draft and review legal agreements that promote and protect the legal rights and interests of the Tribal Government.
6. Negotiate settlements and agreements on behalf of the Tribal Government.
7. Lobby on behalf of the Tribal Government before the executive officials, legislative and administrative bodies of Tribal, federal, state and local governments.
8. Conduct public relations promoting and defending the Tribal Government’s legal rights and interests.
9. Work with the Tribal court system to enhance its status and quality of delivery of judicial services.
10. Be able to work on multiple projects while remaining organized and meeting deadlines.
11. Work effectively with a wide variety of non-legal staff and policy makers.
12. Handle demanding, angry or upset people in a professional manner.
13. Other duties as assigned.

QUALIFICATIONS:

1. Juris Doctorate from an accredited law school.
2. Active membership in the California State Bar, in good standing, or ability to attain reciprocal admission to the Bar within six months of hire.
3. Five years experience that has provided Knowledge and experience in the following legal areas: natural resource management, pollution control, cultural resource management, commercial transactions and real property transactions.
4. Commitment to the ideals of tribal sovereignty and self-determination.
5. Familiarity with basic principles of federal Indian law, including such topics as tribal sovereignty, civil and criminal jurisdiction, contracting under Public Law 93-638 management of trust resources, taxation, and cooperative agreements between Indian tribes and state and local governments.
6. Ability to provide general legal services on a broad array of legal topics.
7. Ability to work with minimal supervision, organize well, and handle multiple projects in a timely manner.
8. Ability to communicate the law and complex ideas in a manner understandable to laypersons.
9. Ability to communicate effectively in legal pleadings and in court.
10. Physical abilities to do the functions of the job, including handling the stress of litigation, public speaking, and high work demands, travel on an as-needed basis, occasional long hours, and other physical and emotional demands normally placed on attorneys.
11. Ability to meet the responsibilities and duties of the position as outlined above.
